This publication contains the current statutes and regulations governing the practice of engineering, architecture and land surveying in Guam. A number of provisions became effective immediately after it was signed into law.

Engineers, Architects and Land Surveyors registered in Guam are obligated to become familiar with all statutes, rules and regulations affecting the practice of their respective profession. Registrants should take the necessary steps to ensure compliance.

INTRODUCTION

In October 1997, legislation referred to as "Bill 462" was adopted to amend and in some cases delete outdated and unclear language contained in the current statutes and rules and regulations governing the PEALS Board:

  • To more adequately and fully define the Board's functions and to keep abreast of Board activities and policies with the Boards of other states and in the professional environment within Guam;


  • To make the Board more effective in its function of protecting the public from those persons practicing engineering, architecture or land surveying on Guam without a license.

The Board acknowledges and sincerely appreciates those individuals and the various professional associations for their commentaries and input in the formulation of Bill 462, including their testimonies during the legislative public hearing.

In August 1998, revisions to the PEALS Law was passed by the 24th Guam Legislature and became Public Law 24-263. Significant changes to the licensing law include:

  • Giving the Board authority to hire at least three permanent employees, and to provide adequate staffing for the Board;


  • Giving the Board full authority over its funds;


  • Authorizing to require a demonstration of continuing professional competency of registrants as a condition of renewal or relicensure;


  • Amending the requirements and guidelines for the issuance of Certificates of Authorization to qualified firms; and


  • Giving the Board authority for citation and fining unlicensed individuals and firms engaged in the unlawful practice of engineering, architecture and land surveying.

The revised statutes are printed herein. The unchanged and still valid provisions of P.L. 11-218 and P.L. 18-43 are also reprinted herein. Questions regarding the PEALS Law may be directed to the Board's office.
